WAIVER AND PRIVACY POLICY FOR THE PARTICIPATION IN SPIEDLIFE.COM CASTING

The undersigned aspiring participant,

Provided that:

(a)	VisioRay Entertainment S.r.l. with offices in Catanzaro, Viale Magna Grecia n. 51/B, VAT and Fiscal Code n. 03654900798, in the person of Mr. Livio Sinopoli, administrator and legal representative (hereinafter “Production”), created the format of an audiovisual  program that presents the characteristics of a reality-show lacking, however, any form of direction and programming, that can be viewed live on the web platform www.spiedlife.com (hereinafter  “Site”) and named “SPIEDLIFE” (hereinafter “Format”);
(b)	navigating the Site, Users (hereinafter also referred to as the “Audience”), choosing between different live channels, can follow the participants’ everyday life, whether families, private individuals, friends, housemates, artisans, noteworthy individuals, entrepreneurs and other subjects of interest to the Audience;
(c)	each live channel streams the participants’ everyday life that unfolds in specific spaces (hereinafter collectively called “Locations”); Locations are provided by Content Producers for free and are equipped with webcams and microphones allowing interaction to take place between the Audience and participants through the use of specific tools implemented by Production that may include: chats, blogs, forums casting area for Format participation requests, etc.;
(d)	in order to participate in the Format as a Content Producer and as Protagonists the individual must:
i.	be a national of the country where the Location is situated, or be a foreign citizen with regular residence permit;
ii.	not possess incompatibility and/or impediment causes or any characteristics and/or objective situations that contrast with the format’s time-frame and creation process;
iii.	possess a legal guardian’s explicit consent and authorization, necessary and essential if the aspiring participant is a minor, less than 18 years of age;
having premised all the above, which constitute a fundamental and substantial part of the present document, the aspiring participant in the Format (hereinafter “Participant”) expressly and irrevocably 

DECLARES
(a)	to possess the requirements  listed under letter (d) of the premise and that no causes of impediments, as indicated in the same letter, exist;
(b)	to have read and accepted the terms and conditions concerning the processing of personal data with the modalities and purposes indicated in the policy, (b) to take full responsibility for the information provided, indemnifying Production from any claim and/or action even those deriving from third parties, (c) to be informed and aware of the fact that for some programs download may be admitted, (d) to renounce any remuneration for the use, reproduction, distribution and exploitation of your images, declarations, voice and/or other sounds and photos;
(c)	to propose himself/herself, as in fact he/she is doing, as a Participant and, therefore to accept to undergo a selection for which he/she agrees to prepare a video audition and/or photographic images and/or other documents that personally concern him/her (hereinafter, generally “Audition”) to be sent to Production that shall decide whether or not to approve said candidacy;
(d)	to be fully aware and accepting of the fact that Production, in the context of its entrepreneurial freedom and artistic inclinations, directed towards the success of the Format, will proceed with the selection of the Participant at its sole and unquestionable discretion and judgment, taking into particular consideration, without any order of importance and/or priority, the capacity to communicate, telegenic aspects (without exclusively referring to aesthetic qualities, but, on a larger scale, the capability to attract the audience’s attention through the participant’s image), personality and expressions; (ii) his/her baggage of personal experiences; (iii) family composition or emotional ties; (iv) the Location; (v) notoriety;
(e)	to understand and accept without reserves that providing Production with the Audition clip does not attribute him/her any rights relating to the participation in the Format;

and for effect

AUTHORIZES
for free, in accordance with articles 96 and 97 of the Law on intellectual rights and other rights connected to its exercise n. 633 of April 22 1941 and art 10 of the Civil Code

6) expressly, unconditionally and irrevocably allows Production and/or its assignees, with most ample and valid explicit consent, to use and divulge with any legitimate means of distribution and in any form (video, audio, photo, print, etc.), the Audition or parts of it, including his/her image, name, images and photos that include him/her, his/her behaviors, declarations, voice and/or other sounds;
7) Production and/or its assignees, exclusively, and simultaneously, give their most ample and valid consent, to distribute, represent, communicate to the public, publish, translate, elaborate, compose, transfer, retransfer and reproduce, in any form and through any means, including distribution channels via internet (websites, social networks, web pages, etc.), via satellite and cable, in print format, the Audition or parts of it, your image, the images and photos that include you, your behaviors, your declarations, your voice and/or other sounds, globally and/or for separate clips and sequences, and in its visual and audio components, separately, and the right to use and publish your name and appearance in any circumstance in pairing with and/or in relation to the promotion of the Format or for informative purposes and entertainment. To this regards, Production may select, at its sole discretion, depending on the use, audio, video and photographic material of the audition and make use of it as it pleases as hereby expressly authorized and allowed; the Participant renounces as of now to any claim, action and/or exception in regards;
8) Production and/or its assignees, expressing their most ample and valid consent to use and freely exploit the Audition material, completely or in part and in any way potentially re-elaborated in any TV, cinematic, digital, audiovisual, literary, journalistic project and/or of other nature, in the entire world without limitations of time. 
9) In relation to the previous declarations and authorization, the undersigned Participant declares furthermore: a) to not create situations that contrast with the rights detained by Production on the Audition, committing to sign, if requested, any declaratory document; b) to not have anything to claim from Production and its assignees and, generally, from anyone who uses and legitimately exploits the audition material; c) to expressly indemnify Production from any and all responsibility in all cases of illegal use of the material relating to the Audition by third parties in any form and through any means.

POLICY ON THE PROCESSING OF PERSONAL DATA EX ART. 13 OF THE EU REGULATION 2016/679
The policy is provided for by art.13 of the European Regulation on the matter of personal data protection (Regulation UE/2016679 hereinafter GDPR).

VisioRay Entertainment Srl, already called “Production”, with offices in viale Magna Grecia n. 51/B, 88100 Catanzaro, PEC: visiorayentertainment@pec.it, tel: 0961 34495, data processer, will process personal data released by yourself for the purposes specified below.
The data conferred with the present waiver will be processed with or without the use of electronic tools, in accordance with the existing legislation and terms provided for by art. 5 of the GDPR (transparency, minimization, safety, etc.).

Personal data will be processed for the reasons indicated below:
a)	to contact you in relation to casting carried out by Production, also in regards to other audiovisual productions;
b)	in order to take into consideration your participation request regarding the Audition;
c)	to allow you to send audio/videos/photos useful for the abovementioned consideration, taking into account that said material must not contain third party personal data nor advertising references;
d)	to assess the audition material for selection purposes; 
e)	to use the audition material for other editions of the same Format or for other audiovisual productions, photographs in print form, in the entire world and without limitations of time;
f)	for purposes that are strictly connected and essential to the activities as indicated in the waiver;
g)	in order to send you communications via e-mail and/or telephone.

Within the limits of the purposes indicated for processing, the personal data (images, audiovisual footage and photos) may be object of communication, publication and/or distribution in any form and through any means.
The supply of your data is optional. The lack of consent will hamper the use of images, audiovisual footage and photos relating to the interested subject for the purposes indicated above.

Personal data may be also processed to meet obligations provided by European Union laws and regulations and by provisions of the industry’s Supervisory authority. 
Providing data is necessary, the failure to supply this information will result in the impossibility to achieve the above indicated purposes.
Personal data will be processed in accordance with the current legislation on the protection of personal data and, in any case, in accordance with the principal of confidentiality to which VisioRay activities aspire to, notwithstanding potential obligations relating to the conservation of data for administrative purposes and/or the management of claims or disputes.
No responsibility may be attributed to Production and/or its assignees for testimonies and/or declarations freely expressed regarding your personal data and/or that of third parties, indemnifying Production from any retaliation or claim deriving in consequence of said testimonies and/or declarations.

You may, at any time, request that your personal data be erased by writing to casting@spiedlife.com.
Personal data will be stored on servers situated in Italy and exclusively processed by authorized VisioRay personnel and collaborators and by businesses which are expressly designated as data processors.
The data will not be distributed to third parties if not in respect of the terms and conditions imposed by the laws on the matter and within the limits of the purposes expressed by the present policy and waiver.
Personal data may be transferred towards countries of the European Union and other countries in accordance with the purposes of the present policy and related waiver.

In compliance to articles 15-22 and 34 of the GDPR, you have the right to request from the data processer access to your personal data, the variation or cancellation of said data or the limitation of treatment, or oppose to said processing (the withdrawal of consent regarding the processing does not preclude the legitimacy of the processing previously carried out in accordance with the consent expressed before withdrawal). You may also request that a document be provided, also in digital format, containing your data for portability purposes. 
Said request should be presented to Production using the following methods:
-sending an e-mail to: privacy@visiorayentertainment.com; 
-sending a written request to the the following address: VisioRay Entertainment S.r.l, viale Magna Grecia n. 51/B, 88100 Catanzaro, to the attention of the data processer.

Production will commit to align to your request within 30 days o within a shorter term if provided by law.

Personal data will be saved and processed for an amount of time that shall not exceed the time necessary to pursue the purposes for which they were gathered (“principle of limitation of storage”, art. 5 GDPR), notwithstanding possible obligations stated by law.
